DRAFT FOR LEGAL REVIEW · NOT IN EFFECT · NO SIGNATURES ACCEPTED
01 / Draft status and required review
This is a proposed copyright-assignment arrangement requested by Liu Qiming, not an active contract or a representation that any transfer has occurred. Participation currently proceeds solely under the separate non-exclusive project-use agreement. A submission checkbox, ordinary registration or the publication of this draft does not execute an assignment.
Before use, qualified legal counsel must determine applicable law and forum, party identification and capacity, assignment formalities, compensation and consideration, statutory termination or reversion, moral-rights limits, privacy obligations and an appropriate electronic signature process. Any mandatory rule prevails over the proposed terms below.
02 / Proposed parties and identified materials
The proposed assignor is the adult participant who is the actual owner of the specified original materials. The proposed assignee is Liu Qiming personally, unless a future reviewed agreement identifies a different lawful recipient. A material schedule must identify each text or file, its submission and material identifiers, immutable content reference or file hash, and any excluded third-party components.
Only copyright economic rights actually owned by that participant and legally transferable may be assigned. Third-party licensed materials are excluded unless their rightsholder separately and lawfully executes the necessary arrangement. Likeness, privacy, personal data, other people’s performances and rights that cannot be transferred are not acquired by a general copyright assignment. Other works the participant has not submitted remain outside its scope.
03 / Proposed assigned rights and uses
Subject to applicable law and the final material schedule, the proposed assignment covers transferable rights to reproduce, distribute, publicly display or exhibit, communicate or make available, translate, arrange, edit and adapt the identified materials, and authorize those uses. The final agreement must map these descriptions to the applicable jurisdiction’s actual statutory rights rather than assume that every legal system uses the same categories.
The proposed scope would permit Liu Qiming to edit, adapt, present, preserve, research, publish and commercially use the assigned materials, including in project documentation, exhibitions, publications and properly authorized commercial licensing. Commercial use is a substantive part of this proposed assignment and requires a clear separate explanation before signature; it is not part of today’s limited project-use permission.
The proposed territory is worldwide. The proposed term is the remaining duration of each transferred copyright, including legally applicable extensions, subject to mandatory termination, reversion and other non-waivable rights. The proposal is gratuitous, with no automatic remuneration, only if the applicable law permits this and counsel confirms any necessary consideration or other requirement. Otherwise the compensation clause must be revised.
04 / Proposed non-commercial sharing permission
Only after a legally effective assignment, Liu Qiming would grant the participant a limited, non-exclusive, royalty-free permission to share that participant’s own assigned materials and the authorized presentation of their contribution for non-commercial purposes, crediting “Liu Qiming, The Living Echoes” and providing the project link. The participant must not claim authorship of the entire artwork or imply endorsement.
Non-commercial means no sale, charge, paid licensing, advertising monetization, sponsored promotion, merchandising or use to market goods or services. Ad-supported channels, branded collaborations, paid memberships giving access to the content and promotional campaigns would require Liu Qiming’s prior written permission, unless a statutory exception independently applies. A genuinely private or unmonetized personal or scholarly sharing context may fall within the permission, subject to the final reviewed wording.
These restrictions would apply only to the materials validly assigned and the project content covered by the sharing permission. They would not govern the participant’s unsubmitted work, third-party rights or legally permitted uses. They do not apply as an assignment restriction to participants’ original materials under the current non-exclusive agreement. AI output is shareable only to the extent permitted by law, applicable provider terms and rights actually held.
05 / Proposed separate electronic execution
The proposed assignment would become effective only after legal approval and a separate execution process satisfying applicable law, including the required signatures and delivery or acceptance. It would identify the specific parties and material schedule and present the full bilingual agreement before signature. A general consent to participate or publish must not substitute for this process.
The future process must preserve the agreement version and immutable full text, signature intent, signing time, precise material associations and legally necessary authentication and audit evidence; provide a downloadable executed copy; and disclose any identity information or signature-provider processing separately. Data collection must remain proportionate. No such assignment-signing service is currently enabled.
No participant should be told that copyright has transferred merely because they contributed. Earlier non-exclusive submissions must not be converted retrospectively without a fresh, separately valid arrangement.
06 / Withdrawal, AI and unresolved legal terms
Withdrawal from public display, personal-data deletion and an assignment’s legal effect must be addressed separately. A request to stop displaying content would not automatically rescind every valid transfer; statutory termination or other mandatory rights would still apply. The final agreement must specify applicable withdrawal and reversion routes without promising instant destruction of all prior copies.
No guarantee is made of copyright or exclusivity in AI-generated results. The assignment must not purport to acquire output rights that do not exist or third-party rights that the participant does not possess. Liu Qiming’s own legally protected work and original project composition remain separately identified.
Applicable law and forum, verified party details, consideration or compensation, exact right categories, moral rights, duration and termination, privacy and cross-border processing, commercial-use scope, the sharing permission and electronic execution all require legal review before activation. The current submission system keeps this draft inactive and records non-exclusive permission instead.
